These Terms of Use ("Terms") govern your use of www.mcbprofessionals.com (the "Site"), operated by MCB Professionals LLC ("MCB Professionals," "we," "us," or "our"). By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1. Information only; no professional advice

The content on the Site is general information about revenue cycle management and our services. It is not legal, tax, financial, coding, compliance or medical advice, and it does not replace advice from a qualified professional about your specific situation. Payer rules, coding guidelines and laws, including the No Surprises Act, change often, and the Site may not reflect the latest changes.

2. No client relationship

Using the Site, contacting us or requesting a consultation does not create a client, business associate or other professional relationship. A relationship begins only when you and MCB Professionals sign a written services agreement, and the terms of that agreement govern our services.

3. Performance targets are not guarantees

Figures on the Site, such as a 98% first-pass claim accuracy target, a 97% collection rate target, a 32% targeted reduction in days in A/R and a 30% targeted increase in collections, are goals we work toward. They are not promises, guarantees or predictions of results for any particular practice. Actual results depend on many factors outside our control, including specialty, payer mix, payer behavior, documentation quality and your starting point. Testimonials reflect the experience of the individuals quoted and do not guarantee similar results.

4. Do not send protected health information

Do not submit patient information or other protected health information (PHI) through the Site, its forms or ordinary email. See our Privacy Policy for details.

5. Acceptable use

You agree not to:

  • use the Site for any unlawful, fraudulent or harmful purpose;
  • submit false information or impersonate any person or organization;
  • interfere with the Site's operation, security or servers, or introduce viruses or harmful code;
  • attempt to gain unauthorized access to any part of the Site or its systems; or
  • copy, scrape or reuse the Site's content for commercial purposes without our written permission.

6. Intellectual property

The Site and its content, including text, graphics, logos, the MCB Professionals name and design, are owned by or licensed to MCB Professionals and are protected by intellectual property laws. You may view and print pages for your own informational, non-commercial use. Any other use requires our prior written permission.

7. Third-party links and services

The Site may link to third-party websites or use third-party services. We do not control and are not responsible for their content, policies or practices, and a link does not mean we endorse them.

8. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MCB PROFESSIONALS AND ITS OWNERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR REIMBURSEMENT, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless MCB Professionals and its owners, employees and contractors from any claims, losses, damages and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

11. Governing law and venue

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in New Jersey, and you consent to their jurisdiction.

12. Changes and general terms

We may update these Terms or change or discontinue the Site at any time. Updated Terms take effect when posted on this page with a new effective date. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Site.
